In the case of capital goods, the Ministry of Economy has been promoting a reduction to... 0% Regarding import tax. It should be noted that, without the application of the regime, the tax incidence would be in the order of 14%.
As described in Article 12 of Ministry of Economy Ordinance No. 309/2009, which establishes the procedural rules for analyzing requests for temporary reduction, "the determination of the existence of equivalent national production will be made through a Public Consultation on the Ministry of Economy's website, (...) without prejudice to other means of proof, such as:
I – A certificate or statement issued by a national trade association representing Brazilian manufacturers of the goods being sought for import;
II – Direct consultation with national manufacturers or their representative bodies; or
III – "The Secretariat for Industrial Development, Commerce, Services and Innovation's own registry of goods produced domestically."”
Applications for tariff exemptions for BK and BIT must be submitted to the Secretariat for Industrial Development and Competitiveness of the Ministry of Industry, Foreign Trade and Services (SDCI/MDIC), with information regarding the applicant, the product's technical data, and the import operation.
It is recommended that applications be accompanied by experts in the field, as any discrepancy in the information provided may result in the application being rejected.
The average processing time for each request is 45 days, This may vary, either higher or lower, depending on the accuracy of the information and/or documents submitted at the time of completion.
