The electronic auction procedure is governed by Ordinance 548/2009 and is intended to receive bids remotely, in a public session, through a system that promotes communication via the Internet, using encryption and authentication resources that enable adequate security conditions in its stages.
Participation of Legal Entities (Companies)
1. To participate in the auction via the "Internet" (Electronic Auction System), legal entities must be duly constituted and registered in the National Registry of Legal Entities – CNPJ.
2. Participation will be through the use of a valid Digital Certificate as per IN No. 1077/2010, which provides for the e-CAC, without prejudice to the interested party observing the rules of each auction notice and the Ordinance that regulates the Electronic Auction System.
3. To participate, the interested party must access the Virtual Taxpayer Service Center (e-CAC) using a valid digital certificate, selecting the "Electronic Auction System" service option.
Observation:
– It is possible to participate in the Electronic Auction through Digital Certificate valid:
a) the legal representative of the company as listed in the CNPJ (Brazilian National Registry of Legal Entities);
b) by granting an Electronic Power of Attorney directly on e-CAC, where both the grantor and the grantee must possess a Digital Certificate. In this case, the Electronic Power of Attorney is granted directly online, without the need to appear in person at a RFB (Brazilian Federal Revenue Service) unit; or
c) by means of Request for Power of Attorney for the Brazilian Federal Revenue Service, in the event that the grantor does not possess a digital certificate.
1. If expressly stated in the auction notice, participation by individuals will be permitted in the bidding for certain lots whose characteristics are typical of products intended for use or consumption. In this case, the lot may be purchased by either an individual or a legal entity.
2. To participate in the auction via the Internet (Electronic Auction System), individuals must have a regular registration status in the Individual Taxpayer Registry – CPF.
3. Participation will be through the use of a valid Digital Certificate as per IN No. 1077/2010, which provides for the e-CAC, without prejudice to the interested party observing the rules of each auction notice and the Ordinance that regulates the Electronic Auction System.
4. To participate, the interested party must access the Virtual Taxpayer Service Center (e-CAC) using a valid digital certificate, selecting the "Electronic Auction System" service option.
Observation:
– It is possible to participate in the Electronic Auction through Digital Certificate valid:
a) of the digital certificate holder;
b) by granting an Electronic Power of Attorney directly on e-CAC, where both the grantor and the grantee must possess a Digital Certificate. In this case, the Electronic Power of Attorney is granted directly online, without the need to appear at a RFB (Brazilian Federal Revenue Service) unit; or
c) by means of Power of Attorney Request for the Federal Revenue Service, in the event that the grantor does not possess a digital certificate.
