{"id":2391,"date":"2019-06-27T17:21:58","date_gmt":"2019-06-27T20:21:58","guid":{"rendered":"https:\/\/dbtesser.siteup.dev\/a-demora-no-desembaraco-de-mercadorias-e-bens-importados\/"},"modified":"2019-06-27T17:21:58","modified_gmt":"2019-06-27T20:21:58","slug":"the-delay-in-clearing-imported-goods-and-merchandise","status":"publish","type":"post","link":"https:\/\/dbtesser.com.br\/en\/a-demora-no-desembaraco-de-mercadorias-e-bens-importados\/","title":{"rendered":"The delay in clearing imported goods and merchandise."},"content":{"rendered":"<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" src=\"https:\/\/dbtesser.com.br\/wp-content\/uploads\/2026\/02\/SITE-11.jpg\" alt=\"\" class=\"wp-image-320\"\/><\/figure><\/div>\n\n\n\n<p>According to a report broadcast on Jornal Nacional on June 24, 2019, delays in the customs clearance of imported goods and merchandise are causing enormous losses to importers, since, in the vast majority of cases, in addition to hindering the free exercise of their commercial activity, it generates a growing increase in storage expenses and... <em>demurrage<\/em>.<\/p>\n\n\n\n<p>Therefore, companies have increasingly resorted to the Judiciary in order to secure their rights, especially the right to property and the free exercise of their economic activity.<\/p>\n\n\n\n<p>This is because, as is well known, although the legal system has not set a deadline for the completion of the import clearance process, by analogy, the 8 (eight) day period contained in Article 4 of Decree No. 70.235\/72 must be respected, counted from the day of registration of the Import Declaration, since, as stipulated in Article 545 of the Customs Regulations, the clearance process begins on the date of registration of the Import Declaration:<\/p>\n\n\n\n<p>Decree No. 70.235\/72:<\/p>\n\n\n\n<p>Article 4. Unless otherwise provided, the employee shall execute the procedural acts. <strong>within eight days<\/strong><strong>;<\/strong><\/p>\n\n\n\n<p>Decree No. 6,759\/2009:<\/p>\n\n\n\n<p>Article 545. The import clearance process is considered to have begun on the date the import declaration is registered.<\/p>\n\n\n\n<p>In this sense, recent paradigmatic decisions.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p> \u201c&quot;According to the legal system, administrative activity must be carried out within a reasonable timeframe, which cannot be prolonged indefinitely.&quot;.<br> &nbsp;<br> <em>In casu<\/em>, I understand that the deadline established by article 4 of Decree No. 70.235\/1972, of 8 (eight)<br> days:<br> &nbsp;<br> <em>\u201c&quot;Article 4.
