A Brazilian Federal Revenue Service, The customs authority is the body responsible for exercising control and oversight of all foreign trade operations, monitoring the entry and exit of goods from the country.
Types of parameterization channels, regulating import customs clearance:
- GreenNo customs clearance is required – The system automatically registers the release of goods, eliminating the need for document review and physical inspection of the merchandise.
- YellowThere is a documentary review – If no irregularity is found, and customs clearance is carried out, physical verification of the goods is waived. In the event of an incomplete description of the goods in the Import Declaration (DI), which requires physical verification for its perfect identification in order to confirm the correctness of the tax classification or the declared origin, the conclusion of the documentary examination may be conditional upon physical verification of the goods.
- RedThere is a physical and documentary inspection – The goods are only released after the documentary examination and physical verification of the goods have been carried out.
- GrayThere is a physical and documentary inspection, and a special procedure is applied to verify fraud.
Observations:
- Setting the parameter to the green channel does not prevent the Inspection Department from manually selecting the Import Declaration for further analysis;
- It is prudent to have a lawyer present during the special inspection procedure, although this is not mandatory, given the numerous documents requested by the inspection authorities.;
- The initiation of a special customs control procedure generally requires the retention of goods.
